BUYER
The customer whose name, delivery/billing address and contact details are provided during the order.
2. Subject
This Distance Sales Agreement governs the mutual rights and obligations of the parties regarding the sale and delivery of the product ordered electronically by the Buyer via nestmoment.com, in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
3. Product and Payment Details
The type, quantity, key features and sale price (VAT included) of the product are as shown in the order summary and on the invoice, if any. Our products are made to order, laser-engraved in 3D inside crystal glass from the ultrasound image you provide. Any shipping fee is shown separately in the order summary before payment.
4. General Provisions
The Buyer declares that they have read and understood the preliminary information regarding the product’s key features, sale price, payment method and delivery, and have given the required approval electronically. The Pre-Information Form approved before the order and this agreement are provided to the Buyer via a durable medium.
5. Payment
Payments are collected securely via the PayTR virtual POS infrastructure by credit/debit card. Your card details are not seen or stored by the Seller; payment is processed through the licensed payment provider’s secure system.
6. Delivery
As products are made to order, production begins after the Buyer approves the 3D preview. Production (processing and engraving) usually takes 3–5 business days. The product is shipped throughout Türkiye via our contracted courier; after handover to the courier, delivery usually takes 1–3 business days. For international shipping, please contact the Seller before ordering.
7. Right of Withdrawal and Its Exception
As a rule, the Buyer has the right to withdraw from the agreement within 14 (fourteen) days of delivery without giving any reason.
Important — personalized product exception: Pursuant to Article 15/1-(ç) of the Regulation on Distance Contracts, there is no right of withdrawal for goods prepared in line with the Buyer’s requests or personal needs, i.e. custom-made/personalized goods. Since our products are made specifically from the ultrasound image you send, the right of withdrawal cannot be exercised once production has started (after the 3D preview is approved). Before production begins (before preview approval), the order can be cancelled and the payment refunded.
8. Cancellation, Return and Refund
- Order cancellation: Before production begins (before preview approval), the order can be cancelled and the amount paid is fully refunded.
- Defective/damaged product: If the product arrives broken, faulty or different from the order, contact us within a reasonable time via contact@nestmoment.com or WhatsApp; we will replace it free of charge or start the return process.
- Refund: For approved returns/cancellations, the refund is made to the card/account used for payment within 30 days at the latest from approval. Bank posting times may vary.
9. Dispute Resolution
For disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer’s or Seller’s place of residence are competent, within the monetary limits announced by the Turkish Ministry of Trade.
10. Effect
By approving the order electronically, the Buyer declares that they have read, understood and accepted all terms of this agreement. The agreement enters into force upon approval of the order.
